ISLAMABAD: On Saturday, an additional district and sessions judge ruled that the Pakistan Tehreek-e-Insaf (PTI) chairman’s Toshakhana lawsuit could proceed.
Court declares Toshakhana case maintainable: Judge Humayun Dilawar of the district and sessions court declared a reserved decision regarding the case’s maintainability and scheduled a hearing for July 12.
The court rejected the chairman of PTI’s request to postpone the case and a second petition seeking to declare the case as unmaintainable.
Amjad Pervaiz, the attorney for the election commission, had stated that Barrister Ali Gohar had appeared in court on the case’s opening day.
Attorney Gohar claimed that it is up to the accused to decide who will represent him in court. He asked with the judge to extend the deadline for the case’s arguments until Monday. We have a legal right to be heard. The court has given us until Monday since Khawaja Haris has been in Lahore, according to Barrister Gohar.
According to Article 63(1)(p) of the Constitution, the election commission had last year in October disqualified the former prime minister in the Toshakhana matter for making “false statements and incorrect declaration.”
Additionally, The former prime minister appealed the trial court’s ruling to the Islamabad High Court, which referred the matter back to the trial court for reexamination within seven days.
However, The court dismissed the motion for adjournment and determined that the case can proceed.
