Imran Khan, the chairman of the PTI, requested that the Supreme Court grant a suspension of proceedings in his criminal case against Toshakhana.
SC rejects Khan’s plea in Toshakhana case:. The PTI leader’s appeal against a high court ruling was dismissed by the court.
It declared that it was requesting that Imran Khan’s appeal and other motions be decided concurrently by the high court.
The court insisted that it would not be appropriate to intervene with the trial court’s proceedings.
According to the attorney for the election commission, the high court sent the matter back to the trial court for a new trial, which resulted in the case being deemed maintainable.
Amjad Pervaiz claimed that the PTI leader was once more contesting the case’s declaration of maintainability.
The Supreme Court will hear his re-appeal in high court tomorrow, the attorney informed the court.
The election commission official had previously been summoned to the rostrum by the Supreme Court, who informed him that he would be heard today and that a decision would be made.
In response to Imran Khan’s plea, the SC had sent a notice to the Pakistani Election Commission.
The hearing was conducted by a Supreme Court division bench presided over by Justice Yahya Afridi.
Khawaja Haris, the attorney for Imran Khan, stated that they wanted the case to be assigned to a different court.
We also contested the court’s jurisdiction, he said, adding that the high court did not rule on these two of their arguments.
“Chaos in Court: Justice Afridi Refers High-Profile Case to Islamabad High Court”
According to Justice Afridi, the jurisdictional issue should have been resolved first.
We’ll ask the high court to rule on all of the applications jointly, he said.
Khawaja Haris informed the SC that his client was invited by the trial court today to record a statement under Section 342 and that they wanted the trial in the matter to be postponed merely for today.
Justice Musarrat Hilali said, “We are referring your case to the Islamabad High Court,” and inquired, “How do we issue directions to the trial court?”
The court had already expressed annoyance over the disturbance outside the courtroom before the session began.
Khawaja Haris was sent by Justice Afridi to assess the situation.
Justice Afridi said, “We cannot hear the case in this manner. Everyone must respect the court.”
He continued by saying that the petitioner and attorney are responsible for upholding the court’s respect.
The PTI leader was present in court; however, a lot of uproar caused the bench to up and leave. Despite the PTI leader’s presence, the proceedings were disrupted, leading the bench to abruptly leave the courtroom.
It took ten minutes before the two-person bench arrived.
The court’s dignity was restored, and the two judges entered the hearing room. When there was silence outside the courtroom, the hearing was resumed.
