Imran Khan, the chairman of the Pakistan Tehreek-e-Insaf, has appealed the Islamabad High Court’s decision from last Friday in the criminal case of Toshakhana to the Supreme Court.
Imran moves SC against IHC verdict: The former premier’s legal team submitted an application to the Supreme Court on his behalf. The petition intended to have the Toshakhana case declared unmaintainable.
In the meantime, the Islamabad District and Sessions Court said that if the petitioner’s attorney does not appear to extend the last arguments as per the high court orders, it will announce its decision in the Toshakhana criminal case against Imran Khan at noon.
As directed by the IHC, Additional District and Sessions Judge Humayun Dilawar then postponed the hearing until noon for the third time today because the PTI chief’s attorney had ignored multiple summonses to appear.

As directed by the IHC, Additional District and Sessions Judge Humayun Dilawar then postponed the hearing until noon for the third time today because the PTI chief’s attorney had ignored multiple summonses to appear.
Judge Humayun Dilawar declared the third break in the day’s proceedings as the associate attorney was unable to predict when senior counsel Khawaja Harris would appear in court.
What would happen if the attorney didn’t show up until late at night? he pondered.
“Khawaja Harris Summoned by Court, Ruling on Toshakhana Case Invalidated by IHC”
The judge said that Khawaja Harris had been summoned by the court at 8:30 am. The judge also added that if a defendant does not show up on the first summons, the court will issue an arrest warrant without the possibility of bail.
The court requested that the attorney for the electoral commission recite some poems as they waited for Khawaja Harris before calling the third break till 10:30am.
Vo mila to sadiyon ke baad mere lab par koi gila na tha, Amjad Pervaiz recited a stanza. When using guftugu, say, “Usay meri chup ne rula diya.”
The courtroom erupted in appreciative cries of “wah wah” at this point.
The IHC deemed the Toshakhana criminal case judgement from the district and sessions courts invalid on Friday. However, they denied Imran Khan’s appeal to have the case declared non-maintainable.
While the court denied the request to move the Toshakhana case to a different court, they sent out notices regarding the desire to reinstate the right to defense for the following week.
Additionally, Imran Khan was unable to request a court injunction for an immediate stay.
The ruling recommended that the sessions court rehear the case before making a decision.
