Fawad Chaudhry, senior vice president of the Pakistan Tehreek-e-Insaf (PTI), was granted bail on Wednesday by a district and sessions court in a sedition case brought against him by the Pakistan Election Commission (ECP).
After a case was filed against him at Islamabad’s Kohsar Police Station, Fawad was taken into custody from his Lahore apartment in January. He is being held on sedition charges for allegedly “threaten[ing]” the members of the ECP in front of the public during a media interview.
Further Sessions The application for bail by the former federal minister of information was accepted by Judge Faizan Gillani. Gillani granted the petition with the proviso that Fawad refrain from making similar comments in the future. The bail amount of Rs 20,000 was approved by the court against surety bonds.
The former federal communications minister was brought before the court after his two-day remand expired, and the decision was then made.
The hearing today
At the beginning of today’s session, Fawad’s attorney Babar Awan requested that the court grant his client’s request for release. The nation doesn’t think that someone should be charged with such a crime for saying just two words.
The court then questioned the attorney about what Fawad meant when he threatened the family members of the ECP employees after asking Awan to read the accusations against the PTI leader.
Fawad is a prominent lawyer and a member of parliament, the judge said. In response, Awan claimed that Shireen Mazari, the PTI leader, had previously been referred to as “tractor trolley.”
The judge then inquired once more as to what Fawad meant when he made reference to the ECP members’ families. “Do you (Awan) know the Pakistani literacy rate? Do you know what would result from such statements coming from a political figure?”
Judge Gillani pointed out to Awan that Imran Khan had used a similar tone when referring to Judge Zeba Chaudhry. He was the Chairman of PTI at that time.
Awan informed the judge, “Yes, I had also resolved the issue.
Following Awan’s arguments, the prosecutor spoke against the release of Fawad. He claimed that the election commission’s officers were singled out and referred to as “peons.”
“Fawad’s Remarks Incite Opposition and Call for Revolution – Evidence Held by Police”
The prosecutor contended that Fawad’s remarks incited opposition to the electoral commission and that he declared on live television that a revolution was “necessary” in the nation.
He further stated that Fawad is the subject of documented evidence held by the police.
The PTI leader’s photogrammetric and voice match tests were carried out while he was in detention, according to ECP attorney Saad Hassan. The judge responded by asking, “What was the necessity for these tests if Fawad had accepted the statements?”
“During the trial, Fawad Chaudhry is permitted to retract his prior statement. As he has acknowledged that he made the statement, we don’t need to question it any further.”
The attorney for the election commission stated that additional research can be done at any stage in case going ahead.
The court said that Fawad Chaudhry shouldn’t have made such comments but granted him bail.
